A BILL FOR A LAW TO AMEND THE WATER SECTOR REGULATION LAW, 2017 BY REMOVING, IN THE SCHEDULE TO THE LAW, THE REFERENCES TO APPEALS WHICH ARE PROPERLY PROVIDED FOR UNDER THE AUTHORITY OF THE OVERARCHING UTILITY REGULATION AND COMPETITION LAW (2018 REVISION)

MEMORANDUM OF OBJECTS AND REASONS

This Bill removes reference to appeals in paragraph 5(7) of the Schedule to the Water Sector Regulation Law, 2017 (“the WSR Law”), concerning promotion of transparency, as the wording does not properly provide for appeals to the Grand Court. Sufficient and proper provision for appeals is provided for in sections 91(11) and 92 of the overarching regulatory Law, the Utility Regulation and Competition Law (2018 Revision).

Clause 1 of the Bill contains the short title of the legislation.

Clause 2 of the Bill amends paragraph 5(7) of the Schedule to the WSR Law, concerning promotion of transparency, specifically reference to appeals. Sufficient and proper provision concerning appeals is provided for in the overarching regulatory Law, more specifically, in sections 91(11) and 92 of the Utility Regulation and Competition Law (2018 Revision).

ENACTED by the Legislature of the Cayman Islands. This Law may be cited as the Water Sector Regulation (Amendment) Law, The Water Sector Regulation Law, 2017 (Law 16 of 2017) is amended in paragraph 5(7) of the Schedule by deleting, after the word “procedures,” the words “and ultimately be reviewable by the Grand Court in the last resort”.
